Terms of Service

This Service must use TikTok’s official API and comply with TikTok’s Terms, Developer Policies, Community Guidelines, and applicable French & EU law (including GDPR).

1. Agreement

These Terms of Service (“Terms”) govern your access to and use of My tiktok uploader (the “Service”), operated by SASU François Ménétrier, registered in France with registration number R.C.S. Evry 903790319 (“we”, “us”, “our”). By using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

The Service enables users to connect a TikTok account via TikTok’s official OAuth process and to upload, schedule, and publish content automatically to TikTok using the official TikTok API. We do not store TikTok passwords; we store only API access tokens issued by TikTok to perform actions expressly authorized by you.

The Service is independent from TikTok and is not endorsed by TikTok. Your use of TikTok remains governed by TikTok’s policies, including their Terms of Service, Community Guidelines, and Developer Terms, which you must comply with at all times.

5. TikTok Compliance

By connecting your TikTok account, you authorize the Service to act on your behalf via the official TikTok API for the limited purpose of posting and managing content that you choose. All actions must comply with TikTok’s Terms, Community Guidelines, and Developer Policies. TikTok may suspend or restrict your TikTok account for violations of its policies. We are not responsible for any enforcement actions taken by TikTok.

6. Data Privacy (GDPR)

We process personal data in accordance with the EU General Data Protection Regulation (GDPR) and applicable French law. Categories of data may include account identifiers, contact details, TikTok API tokens, and operational logs necessary to provide the Service. Processing purposes include authentication, scheduling, posting, security, support, and analytics (where possible, we use aggregated or anonymized data).

Data Rights

Under GDPR, you have the right to access, rectify, erase, restrict, object to processing, and data portability. To exercise these rights, contact us at contact@francoismenetrier.net. You also have the right to lodge a complaint with a supervisory authority such as the CNIL (France).

Security & Storage

We implement appropriate technical and organizational measures to protect data. We do not sell personal data. We do not store TikTok passwords. Data may be hosted in the EU or with processors providing GDPR-compliant safeguards and, where applicable, appropriate transfer mechanisms (e.g., SCCs).

7. Subscription, Billing & Refunds

Fees (if any) are described at [PRICING URL] and are billed in advance. You may cancel at any time; unless required by consumer law, no refunds are issued for partial billing periods. Consumers in the EU retain applicable statutory rights, including legal guarantees and withdrawal rights when applicable.

8. Intellectual Property

The Service (software, UI, documentation, trademarks) is owned by SASU François Ménétrier and protected by law. You retain ownership of your content. You grant us a limited, revocable, non‑exclusive license to host, process, and transmit your content solely to provide the Service.

9. Limitation of Liability

To the fullest extent permitted by French and EU law, we are not liable for indirect, incidental, special, or consequential damages; for lost profits, lost engagement, or account suspension by TikTok; or for damages arising from user content or third‑party services. Our total liability for any claim shall not exceed the fees paid by you for the Service during the last billing period. Nothing excludes liability for fraud, gross negligence, or rights that cannot be excluded under EU consumer law.

10. Termination

We may suspend or terminate access immediately if you breach these Terms, if TikTok modifies or revokes API access, or for legal/security reasons. You may stop using the Service and request account deletion at any time. Upon termination, certain provisions (including IP, liability, and governing law) will continue to apply.

11. Governing Law & Disputes

These Terms are governed by French law, subject to applicable EU consumer protection and data protection rules. In the event of a dispute, the parties will seek amicable resolution. Failing that, the competent courts of Evry-Courcouronnes, France shall have jurisdiction, unless otherwise mandated by consumer law.
